  • On the English-language Wikipedia ([2]), hosted on servers in the United States by the non-profit Wikimedia Foundation ([3]),

qualifies as fair use under United States copyright law. Any other uses of this image, on Wikipedia or elsewhere, may be copyright infringement. See Wikipedia:Fair use and Wikipedia:Copyrights.

To the uploader: this tag is not a sufficient claim of fair use. You must also include the source of the work, all available copyright information, and a detailed fair use rationale.

[edit] Fair use for Wreck of the Hesperus

This image, Woth.jpg, is being linked here; though the picture is subject to copyright I feel it is covered by the U.S. fair use laws because:

  1. it is a low resolution copy of a photo of the band (copies made from it will be of very inferior quality);
  2. the photo is only being used for informational purposes (i.e. to show the members of the band);
  3. it does not limit the copyright owner's rights to sell their albums in any way;
  4. copies could not be used to make illegal copies for album artwork;
  5. its inclusion in the article adds significantly to the article because it portrays the band's unique appearance onstage, which is explained in the article.
